Unfair Dismissal
What is Unfair Dismissal?
Unfair dismissal occurs when an employee is terminated from their job in a manner that is considered harsh, unjust, or unreasonable. The concept is recognised in many jurisdictions, particularly in the UK, Australia, and other countries with statutory employment protections. An employee may claim unfair dismissal if there was no valid reason for the termination, if proper procedures were not followed, or if the dismissal was disproportionate to the conduct in question. Employers can defend against claims by demonstrating that the dismissal was for a fair reason such as capability, conduct, redundancy, or legal restriction, and that a fair process was followed.
