What is Summary Dismissal?

Summary dismissal, also known as instant dismissal, occurs when an employer terminates an employee’s contract immediately and without notice. It is generally reserved for cases of gross misconduct, such as theft, violence, fraud, or serious breaches of health and safety rules.

Why Summary Dismissal Matters

Because summary dismissal bypasses the normal notice period, employers must ensure the decision is legally defensible. This typically requires conducting a fair investigation, giving the employee an opportunity to respond, and documenting the grounds for dismissal.
